These Terms & Conditions apply to your use of www.tlwhproject.com and purchases made from TLWH. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Website use

You must use this website lawfully and must not interfere with its operation, security or other users. You must not attempt to gain unauthorised access to the website, accounts or systems, introduce malicious code, scrape the website unreasonably, or use its content in a way that infringes our rights or the rights of others.

Product information

We aim to describe and display our products accurately. Colours and appearance may vary depending on screens, lighting and manufacturing batches. Measurements and size information are approximate unless stated otherwise.

We may correct errors in product descriptions, images, prices or availability. If an error materially affects an order you have placed, we will contact you and offer an appropriate solution, which may include confirming the corrected order or providing a refund.

Prices and payment

Prices are displayed in Australian dollars.

Delivery charges and any other applicable costs will be shown before payment.

Payment must be made using a payment method offered at checkout. You confirm that you are authorised to use the selected payment method and that the information you provide is accurate.

Orders and acceptance

Submitting an order is an offer to purchase the selected products. You will receive an automated order confirmation, but we may decline or cancel an order before dispatch where reasonably necessary—for example, where a product is unavailable, there is an obvious pricing or website error, payment is not authorised, fraud is suspected, or delivery cannot reasonably be completed.

If we cancel an order after payment, we will refund the amount paid for the cancelled product or order to the original payment method.

We may apply reasonable quantity limits to products or releases and may cancel orders that appear intended for unauthorised resale.

Pre-orders

A product marked “pre-order” is not available for immediate dispatch. The estimated dispatch period will be stated on the product page and further information appears in our Shipping & Pre-Orders Policy.

Pre-order dates are estimates and may change due to production, freight or other delays. We will provide an update if timing changes materially. You may request cancellation of a pre-order before dispatch in accordance with our Shipping & Pre-Orders Policy. If we cannot supply the product, we will provide a full refund.

Promotions and discount codes

Promotions and discount codes are subject to any conditions stated with the offer. Unless otherwise stated, a code cannot be combined with another offer, exchanged for cash, applied retrospectively or used after its expiry. We may withdraw or correct a promotion affected by an obvious error or misuse, subject to applicable law.

Delivery, returns and refunds

Our Shipping & Pre-Orders Policy and Returns & Exchanges Policy form part of these terms. Please read them before purchasing.

Intellectual property

Unless otherwise stated, the website and its content—including TLWH names, logos, artwork, product designs, photographs, graphics, text and layout—are owned by or licensed to TLWH and are protected by intellectual property laws.

You may view the website and make a copy of order information for personal, non-commercial use. You must not reproduce, modify, sell, publish, distribute or commercially use our content without prior written permission.

Third-party services and links

The website may rely on or link to third-party services, including payment, delivery, social media and website providers. We are not responsible for third-party websites or services that we do not control. Your use of them may be governed by their own terms and privacy policies.

Liability

To the maximum extent permitted by law, TLWH is not liable for indirect or consequential loss arising from use of the website or a purchase. This limitation does not apply where liability cannot lawfully be excluded or limited, including under the Australian Consumer Law.

You are responsible for ensuring that products are suitable for your intended use and for following any care instructions supplied with them.

Changes and website availability

We may update the website and these terms from time to time. The terms that applied when you placed an order will continue to govern that order unless a change is required by law or agreed with you.

We may suspend or restrict website access for maintenance, security or operational reasons. We do not guarantee that the website will always be available or error-free.

Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and any courts entitled to hear appeals from them. This does not prevent you from exercising rights you may have under applicable consumer law elsewhere in Australia.
